Texas Doctor Says He Defied State Law by Performing Abortion
Antiabortion group is looking into the case of Alan Braid, who said he terminated a pregnancy after six weeks

An antiabortion group in Texas says it is looking into a physician’s claim that he defied a state law that recently took effect by performing an abortion on a woman past the sixth week of her pregnancy.

In an opinion essay published in the Washington Post, Alan Braid disclosed that he performed the abortion earlier in September.

John Seago, legislative director for Texas Right to Life, said the organization is looking into Dr. Braid’s claims. “It definitely seems like a legal stunt and we are looking into whether it is more than that,” said Mr. Seago. He noted that the law contains a four-year statute of limitations for citizens to sue for violations.

In his essay published Saturday, Dr. Braid wrote that he understood he could face legal consequences. “I wanted to make sure that Texas didn’t get away with its bid to prevent this blatantly unconstitutional law from being tested,” he wrote.

Dr. Braid’s act could become the first test case of S.B. 8, also known as the Texas Heartbeat Law, signed by Republican Gov. Greg Abbott in May.

The U.S. Supreme Court earlier this month declined to block enforcement of the law, rejecting an emergency request by abortion clinics on a 5-4 vote. The Biden administration the next week sued to block the law, saying it was unconstitutional. A hearing in the case is set for Oct. 1.

The law bars doctors from performing an abortion once there is a “detectable fetal heartbeat,” which typically happens around six weeks of pregnancy, before some women realize they are pregnant. It provides an exception for medical emergencies that could affect the health of the mother, but not for pregnancies resulting from rape or incest.

Under the law’s provisions, private citizens can sue abortion clinics, doctors, and anyone who helps a woman obtain an abortion and collect a minimum $10,000 in damages plus reimbursed legal costs if they are successful.

Dr. Braid’s Houston clinic is already among the plaintiffs in a lawsuit challenging S.B. 8 in federal court. He declined to comment through a spokeswoman for the Center for Reproductive Rights, which is representing him in the lawsuit.

“Dr. Braid has courageously stood up against this blatantly unconstitutional law,” Nancy Northup, the group’s president, said in a statement. “We stand ready to defend him against the vigilante lawsuits that S.B. 8 threatens to unleash against those providing or supporting access to constitutionally protected abortion care.”

Dr. Braid, who has been practicing in Texas for more than 40 years and has run clinics in Houston, San Antonio, and Oklahoma, has a history of fighting abortion restrictions.

When a 2013 law mandated that doctors perform abortions at hospitals or surgical centers and required providers to have admitting privileges locally, he built a $3 million facility in San Antonio so he could continue providing services there. The U.S. Supreme Court later struck down most of that law’s provisions.

He was previously a named plaintiff in cases targeting a 2011 Texas law that requires women seeking abortions to first receive a sonogram, the 2017 Texas law mandating that fetal remains be buried or cremated, and a 2019 Oklahoma law that required doctors to tell patients that the effects of abortion drugs could be reversed, which medical groups said was false.
