Can I PRETEND to CROSS-EXAMINE the Doctor You Sued During His Pretrial Deposition?
NY Medical Malpractice & Personal Injury Lawyer Gerry Oginski Explains
Maybe your attorney wants to practice his cross-examination strategies.
Maybe he hasn’t been on trial in a while.
Maybe there’s a strategy to cross-examining the doctor you sued when your lawyer questions him during his pretrial deposition.
The better question is, can I PRETEND to cross-examine the doctor during his deposition?
The answer is yes, I can.
Importantly, WHY would I want to cross-examine him during this examination before trial?
There are a number of reasons I might want to do that.
However, you should know that I will also want the doctor to answer many open-ended questions so he can explain what he did and why.
By cross-examining the doctor, I will ask leading questions and call only for yes or now answers. That limits the responses I get from him and doesn’t fully allow me to understand his reasoning and motivation for doing what he did.
